What compulsory insurance covers, the limits of Carent's liability and what to do after an accident.

This Insurance and Protection Policy governs the legal framework of vehicle insurance, the obligations of the parties, the accident/incident protocol and the limits of Carent's legal liability when using the carent.az website and the Carent mobile app ("Carent App", "Platform"), which belong to "CARENT" MMC (limited liability company) ("Carent", "we", "our").


1. Carent Is Not an Insurance Organisation (Marketplace Disclaimer)

"CARENT" MMC IS NOT AN INSURANCE COMPANY OR AN INSURANCE AGENT AND DOES NOT SELL ANY INSURANCE PRODUCT DIRECTLY.

  • The Carent platform does not insure vehicles directly, does not act as an insurance provider and does not pay compensation or indemnify losses in the event of an insured event.
  • The insurance information displayed on the platform (compulsory insurance, comprehensive/kasko insurance and their scope of cover) is official information declared and provided by the car owner (an Individual Host or an official Rent-a-Car company).
  • The vehicle's insurance contract and the associated legal relationships are governed directly between the licensed insurance companies, the car owner and the party at fault within the framework of the legislation.

2. Types of Vehicle Insurance in the Republic of Azerbaijan

Under the legislation of the Republic of Azerbaijan, the following types of insurance apply in vehicle rental:

2.1. Compulsory Motor Insurance (Civil Liability Towards Third Parties)

  • Mandatory Nature: Every car owner (Host) who publishes a listing on Carent is obliged to ensure that the vehicle holds valid Compulsory Motor Liability Insurance.
  • Scope of Cover: It pays, within the limits established by law, for the damage caused by the driver at fault to the property or health of third parties in a road traffic accident occurring during the trip.
  • Exclusion: Compulsory insurance DOES NOT COVER damage to the rented vehicle being driven or the driver's own injuries.

2.2. Voluntary Comprehensive (Kasko) Insurance (Protection of the Vehicle Itself)

  • Voluntary Nature: Kasko insurance is the car owner's individual choice and its presence is stated openly in the listing details.
  • Scope of Cover: Regardless of who is at fault in the incident (depending on the terms), it may cover physical damage to the vehicle itself, natural disasters, fire or theft.
  • Deductible: Kasko insurance may provide for a deductible (a minimum participation amount payable by the car owner or the driver). The deductible amount and its conditions are stated in the listing details.

3. Clarifying the Insurance Details with the Car Owner, and the Insurance Portal

IMPORTANT WARNING: Before booking the vehicle or when collecting it, the Renter IS OBLIGED TO CLARIFY DIRECTLY WITH THE CAR OWNER (HOST) the vehicle's type of insurance (compulsory only, or kasko included), the validity period of the insurance certificate, and, where kasko exists, the deductible amount and any special conditions.

  • The vehicle's insurance documents must be checked in physical or electronic form at the moment of handover.
  • For official information on the types of insurance in force in the Republic of Azerbaijan, the rules of compulsory insurance and the legislation, you may consult the insure.az portal and the official resources of the Compulsory Insurance Bureau.

4. Cases NOT Covered by Insurance and the Renter's Personal Liability

In the following cases, insurance companies refuse payment and all material and legal damage caused is 100% THE PERSONAL LIABILITY OF THE RENTER (DRIVER):

  1. Driving Under the Influence: The driver being behind the wheel under the influence of alcohol, narcotics or psychotropic substances;
  2. Unauthorised Driver: The vehicle being driven by a third party not registered at the time of booking and not approved by Carent;
  3. Prohibited Use: Taking part with the vehicle in races, drifting, speed trials or off-road terrain, or engaging in unauthorised commercial passenger transport (taxi) activity;
  4. Leaving the Scene: Leaving the scene of an accident without calling the State Traffic Police (DYP) and the insurance commissioner;
  5. Invalid Documents: The driving licence being invalid or forged, or the relevant category not being held;
  6. Intentional Damage: Damaging the vehicle's cabin, engine or body intentionally or through gross negligence.

5. Action Protocol in the Event of a Road Traffic Accident

If any accident or insured event occurs during the trip, the Renter must act immediately in the following order:

                 ↓
[3. Notify the Car Owner (Host) and the Insurance Company Immediately]
                 ↓
[4. Record the Scene with Photos from 4 Sides (until the DYP arrives)]
                 ↓
[5. Send a Notification to Carent Support (destek@carent.az)]

Step-by-Step Instructions:

  1. Safety: Stop the vehicle safely, switch on the hazard lights and place the warning triangle. If anyone is injured, call 103 Emergency Medical Aid immediately.
  2. Inform the Police (DYP — 102): Inform the State Traffic Police immediately. Without an official DYP certificate and incident report, insurance companies do not provide payment.
  3. Notify the Car Owner: Inform the Host of the incident immediately by call or chat within the Carent App. Follow the Host's instructions for calling the insurance company to the scene.
  4. Photo and Video Record: Photograph the scene, the position of the vehicles, the road signs, the number plates and all damage clearly.
  5. Notify Carent Support: Report the incident via destek@carent.az or in-app support.

6. Handover Photo Protocol and Resolution of Damage Disputes

  • Mandatory Digital Protocol: The time-stamped and GPS-stamped photo protocols taken within the Carent App at the moment the vehicle is collected (Check-in) and returned (Check-out) are the most important legal evidence in damage disputes.
  • Recording Existing Damage: When accepting the vehicle, the Renter must record in the photos every existing scratch, dent and defect on the vehicle. New damage not recorded in the photo protocol is deemed to have been caused during the trip.
  • Investigation of Disputes: Where a disagreement arises between the parties, Carent provides the photographic evidence and telemetry records uploaded to the system by the parties. Where no agreement is reached, the matter is resolved by the competent courts of the Republic of Azerbaijan.
