Host Agreement
The car owner's obligations — subscription, listing accuracy, compulsory insurance and payouts.
This Host Agreement ("Agreement") is a legally binding formal agreement for all Individual Entrepreneurs (individual hosts) and Official Rent-a-Car Companies (legal entities) ("Host", "You") who offer their vehicle for rent on the carent.az website and in the Carent mobile app ("Carent App", "Platform"), which belong to "KORACL MMC" ("KORACL MMC", "we", "our").
By listing a vehicle on the Platform or by purchasing a subscription plan, you are deemed to have accepted all the terms of this Agreement in full and without reservation.
1. Host Eligibility and Required Documents
To list a vehicle on the Platform, you must meet the following requirements:
- Individual Hosts (Natural Persons):
- Persons of at least 18 years of age with legal capacity;
- Confirmation of an ID card and the FIN code;
- Being the owner of the listed vehicle, or holding a notarially certified power of attorney / right of lease over it.
- Official Rent-a-Car Companies (Legal Entities):
- An enterprise registered with the state in the Republic of Azerbaijan;
- The company's tax ID (VÖEN), an extract from the state register and confirmation of the authorised representative.
- Location Restriction: All listed vehicles must be located within the territory of the Republic of Azerbaijan and must bear Azerbaijani state registration plates.
2. Technical Condition of the Vehicle and Insurance Obligations
The Host bears the following obligations in respect of every vehicle placed on the platform:
- Compulsory Insurance: To ensure that the vehicle holds valid Compulsory Motor Insurance. Renting out a vehicle whose insurance has expired is strictly prohibited.
- Technical Safety: The vehicle must have passed the state technical inspection; the braking system, lighting equipment and steering must be in fully sound condition, and the tyres must be appropriate for the season.
- Cleanliness and Hygiene: The vehicle must be handed over to the renter fully clean, in sound condition and at the fuel level stated in the listing.
- Accuracy of the Listing: The photos in the listing must reflect the real and current appearance of the vehicle. Concealing existing scratches, dents or defects is prohibited.
3. Handover and Digital Photo Protocol (Check-in / Check-out)
- Mandatory Photo Protocol: When handing the vehicle over to the renter (Check-in) and when taking it back (Check-out), the Host must use the Carent App to photograph the vehicle from all 4 sides, together with the odometer and fuel readings.
- Legal Evidence: These photographic proofs uploaded to the app are considered the sole official basis for investigating claims of damage, scratches, fuel differences or delays. A Host who does not draw up a photo protocol forfeits the right to raise a damage claim.
4. Subscription Plans and Payment Model
Unlike traditional high-commission systems, Carent offers car owners 0% Rental Commission:
- Monthly Subscription: A fixed monthly subscription fee is paid in order to list vehicles (from 8.99 AZN for Individual hosts, from 29.99 AZN for companies).
- 0% Commission: Carent withholds zero platform commission from the car owner's rental income — 100% of the earnings belong to the Host.
- Online Payment & Processing Fee (Stripe): Carent partners with the world-class international payment infrastructure Stripe. The only deduction from the rental amount is the 6% online payment processing fee charged by the payment gateway for security and transaction handling.
- Zero Hidden Deductions: Beyond this 6% payment processing fee, no additional service charges, hidden commissions, or deductions will ever be applied. Carent is always by your side.
- Withdrawal of Earnings (Payout Requests): You can request a payout of your cleared balance directly via your Host Dashboard to your bank card or bank account (IBAN). You will find all necessary details, steps, and prompts in your personal Host Dashboard. Payout requests are processed and completed within 24 hours.
5. Booking Rules, Cancellations, and Host Payouts
5.1. Booking Request Management and Automatic Expiry
- Response Deadline: The Host must accept or decline an incoming booking request within 24 hours. If no action is taken, the request is cancelled automatically without penalty, and the renter's pre-authorization is released.
- Payment Deadline: Once approved, if the renter fails to complete payment within 24 hours, the reservation is cancelled automatically without penalty, and the vehicle calendar is freed.
5.2. Payout Conditions and Balance Clearance
- Escrow / Pending Payout: The online payment made by the renter is held in escrow (as pending funds) until vehicle handover is completed.
- Handover Confirmation Requirement: Funds transition to the Host's active, withdrawable balance strictly after the renter confirms vehicle pickup in the Carent App. Confirmation by the Host alone is legally insufficient to unlock payout funds.
- Cash Security Deposit: The security deposit is accepted in cash directly by the Host upon handover and is not processed through online accounts.
5.3. Host Compensation upon Renter Cancellation
When a renter cancels a confirmed reservation, the Host's payout compensation is governed as follows:
| Renter Cancellation Timing | Host Payout Allocation |
|---|---|
| Host has not yet accepted the booking | No payout (vehicle calendar released immediately). |
| More than 24 hours prior to departure (Saver Rate) | No payout (vehicle calendar released immediately). |
| Prior to scheduled trip time under Flexible Rate | No payout. |
| Less than 24 hours prior to departure (Saver Rate) | 1 day's rental fee − bank/processing deductions (transferred after the required waiting window). |
| More than 2 hours after scheduled departure time | Full net rental payout (credited after the 7-day dispute window closes). |
5.4. "Renter No-Show" Special Policy
- Waiting Window: The Host may declare "Renter No-Show" in the application strictly after 2 hours have elapsed from the official departure time. During the first 2 hours, this option remains locked to protect the renter against reasonable transit delays.
- Outcome:
- Once the 2 hours expire and the Host closes the trip, the reservation terminates and the calendar opens immediately;
- No refund is issued to the renter;
- The Host is credited with the full net payout, which is released automatically to their active balance after 7 days if no valid dispute is filed;
- If the renter arrives after 2 hours and the Host has not yet closed the booking, handover may proceed normally upon mutual agreement.
5.5. Cancellation Initiated by the Host and Liability
Voluntary cancellation of a confirmed booking by the Host must be executed via the Carent App under the following lawful grounds:
- Vehicle Issue (Mechanical breakdown, accident, safety defect):
- Permissible strictly prior to scheduled departure time. 100% of paid funds are refunded to the renter, and the Host receives zero payout.
- Recorded against the Host's 12-month fulfillment record. Frequent cancellations diminish search ranking and may lead to account suspension.
- Renter Issue (Document discrepancy, intoxication, unauthorized driver):
- The Host must select the reason, submit an explanation, and upload photographic evidence. Funds are frozen, and the Carent Dispute Department mediates an equitable allocation.
- Prohibition of Unjustified Cancellations: Unjustified cancellation of a confirmed reservation by the Host is strictly prohibited. Repeated offenses may result in permanent termination of platform access.
5.6. Vehicle Rejection and Dispute Resolution
- If a renter inspects the vehicle in person and legitimately refuses handover (e.g., condition does not match listing, mechanical defect, or severe cleanliness failure), funds are held in escrow.
- Carent reviews photo-protocols and statements from both parties to render a final determination.
- Comprehensive cancellation terms and mathematical calculation formulas are governed by the official Cancellation and Refund Policy.
6. Prohibited Conduct and Dealings
- Prohibition of Going Off-Platform: Inviting a renter into a cash deal outside Carent or demanding a hidden commission is strictly prohibited. The account of a Host who breaches this rule is closed immediately and permanently.
- Fake Listings: Listing vehicles that do not exist or that belong to someone else is prohibited.
7. Fraud, Deception and Unilateral Blocking by Carent (Permanent Ban)
IMPORTANT LEGAL PROVISION: A zero-tolerance policy applies on the Carent platform towards fraud, the deception of renters and unethical activity.
-
Cases of Unilateral Blocking: Where Carent detects any of the following, it reserves the right to block (ban) the Host from the platform unilaterally, immediately and permanently, without prior warning:
- Deceiving and misleading the renter: Providing a different, older, technically defective or otherwise dissimilar vehicle instead of the one in the listing;
- Fake photographs and listings: Listing photographs that are not genuine, that belong to another vehicle, or that knowingly conceal existing damage;
- Unlawful and hidden demands: Demanding unjustified additional payments outside the Carent app, undisclosed commissions or hidden cash from the renter;
- Fabricated damage and misappropriation of the deposit: Attempting to attribute to the renter old, pre-existing damage on the vehicle that the renter did not cause, and to misappropriate the deposit without grounds;
- Submitting forged documents: Uploading a forged ID card, an invalid power of attorney, a false tax ID (VÖEN) or expired insurance documents;
- Taking users off the platform: Attempting to take renters outside the Carent system or to induce them into cash deals.
-
No Right to Claim a Refund or Compensation (No Refund):
- A Host whose account is blocked for fraud, deception, abuse of trust or breach of contract MAY UNDER NO CIRCUMSTANCES DEMAND the refund or compensation of monthly subscription fees, advertising payments or any other funds paid to Carent.
- The remaining subscription period is cancelled in full without any compensation.
-
Payment of Material Damage and Legal Liability:
- All material and moral damage caused to the Renter or to the Carent platform as a result of the Host's fraud or unlawful acts is paid in full by the Host at fault.
- Where necessary, Carent submits documents relating to established facts of fraud to the law enforcement authorities of the Republic of Azerbaijan (the Ministry of Internal Affairs, the Prosecutor's Office).
8. Tax Obligations and Legal Liability
- Host's Sole Tax Responsibility: All tax obligations and compliance arising from vehicle rental income are strictly and exclusively the Host's own personal and legal responsibility.
- No Tax Intervention by Carent: The Carent platform does not act as a tax agent for the Host, does not intervene in tax matters, does not calculate taxes, and does not withhold any tax amounts from earnings.
- Independent Tax Filing: Both Individual Hosts (sole proprietors) and Official Rent-a-Car Companies (legal entities) are solely obliged to file tax returns independently with the tax authorities and pay all applicable taxes on their income in accordance with the Tax Code of the Republic of Azerbaijan and relevant legislation.
- Dispute Jurisdiction: All legal relations and disputes arising from this Agreement are governed by the legislation of the Republic of Azerbaijan and resolved before its competent courts.
